1.1.   Welcome to the Ferrari by Logic3 (www.ferrari-by-logic3.com) website “Web Site”. This Web Site is owned and operated by Logic3 plc “Logic3”, whose address is Rhodes Way, Watford, Hertfordshire, WD24 4YW, UK. Registration number 1321309 England. Registered Office, 7 St Johns Road, Harrow, HA1 2EY.

1.2.   In these Terms and Conditions "we" and "us" mean Logic3, and "you" means you the customer.

1.3.   These Terms and Conditions together with your Order Confirmation constitute the Contract between us and you for the supply of Products and Services. No other Terms and Conditions shall apply. The Contract cannot be varied unless we agree to vary it in writing or by email.

1.4.   These General Terms and Conditions do not affect the statutory rights of the customers of Logic3.

1.5.   These Terms and Conditions help to keep the Web Site a safe place to trade and set out the full extent of any agreement reached between you and Logic3 in connection with this site.

1.6.   These Terms and Conditions will be available at all times on the Web Site and may be amended in accordance with paragraph 63 below from time to time.  

1.7.   You should understand that by placing an Order, you accept the following Terms and Conditions:


2. Placing Your Order


2.1.   To place an Order you must be 18 years of age or over and be accessible by non-cellular telephone.

2.2.   By placing an Order, you make an offer to us to purchase the Products you have selected on these Terms and Conditions. We may or may not accept your offer at our discretion.

2.3.   When you place your Order, we will issue you with a Web Order Number and Logic3 will do this via the Web Site. Please note that such a Web Order Number is supplied for reference purposes only and does not constitute our acceptance of your Order.

2.4.   If we accept your Order, we will notify you of our acceptance by issuing an Order Confirmation. We will send your Order Confirmation to you by e-mail provided you have indicated an e-mail address on your Order Form.

2.5.   You agree that e-mail can be used as a long-distance or acceptable means of communication with you.

2.6.   Your Contract for purchases of Products made through this Web Site is with Logic3, and you undertake that any and all Products ordered by you are for your own private and domestic use only. 

2.7.   No Contract for the sale of any Product will subsist between you and Logic3 unless and until Logic3 accepts your Order by way of an e-mail confirming that it has received payment in full for all the Products you have ordered. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time Logic3 sends the e-mail to you (whether or not you receive that e-mail). This confirmation e-mail amounts to an acceptance by Logic3 of your offer to purchase the Products from Logic3.  

2.8.   This confirmatory e-mail will contain all relevant statutory information concerning your Contract.

2.9.   You must check that the details on this confirmatory e-mail are correct as soon as possible and you should print out and keep a copy of it. 

2.10. Logic3 will not pass on your personal or credit or debit card details to any third party.

2.11. You undertake that all details you provide to Logic3 for the purpose of ordering or purchasing Products or Services are correct, that the credit or debit card you are using is your property or authorised for use by you, and that there are sufficient funds to cover the cost of the Products or Services ordered. 

2.12. If there are any changes to the details supplied by you it is your responsibility to inform Logic3 as soon as possible. Logic3 cannot be held responsible or liable for any items processed in accordance with any details held prior to receipt of any changes from you.

2.13. Your statutory rights are not affected (in particular see below as to your rights to withdraw from the Contract) but otherwise all purchases are non-exchangeable, non-refundable and non-transferable, other than as provided hereunder.


3. Placing Your Order – Pre-Orders


3.1.   Pre-Order(s) is a Service provided to you to Order a Product before the official launch date.

3.2.   The official launch date will be clearly written on the individual product pages of the Web Site, which will be the best indication date available at the time and subject to amendment at any time by Logic3 at our discretion.

3.3.   The following conditions apply for Pre-Orders:

3.3.1. Delivery: We aim to deliver Pre-Order Products on the official launch date, provided that we have received and processed your payment.  This is not always possible due to availability at our warehouse. Delivery charges may apply to all Pre-Orders unless otherwise stated. Logic3 will endeavour to deliver on the launch date, however, should there be any unforeseen circumstances or delay, and we will deliver to customers in strict chronological order, which may be after the initial launch date advised for Pre-Orders.


3.3.2. Payment: Payment will be taken as soon as the Order is received. Your Pre-Order purchase is also subject to the Logic3 Terms & Conditions.


4. Prices

4.1.   All prices quoted on our Web Site are in UK Sterling Pounds (GBP)

4.2.   The price for the Products will be the price indicated on your Order Confirmation.

4.3.   Delivery costs, where applicable, are payable by you as indicated on your Order Confirmation.

4.4.   All import costs including duties and local taxes for any deliveries outside UK will be borne by you.


5.  Processing of orders 


5.1.   You may pay for your Products by the methods of payment as displayed on the Web Site.

5.2.   You must pay in the currency as indicated on your Invoice.

5.3.   If you are paying by a credit or debit card, then you must supply your credit / debit card details when you place your Order. All credit or debit cards are debited before items are shipped by Logic3.

5.4.   Every purchase you make shall be deemed performed in the UK. English law shall govern every aspect of contractual agreement concerning orders placed and purchases made from this Web Site.

5.5.   To ensure that your credit, debit or charge card is not being used without your consent (or the consent of another party who has authorised use by you), we will validate name, address and other personal information supplied by you during the Order process against appropriate third party databases. By accepting these Terms and Conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency, which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. 6. Delivery/ Title/ Risk  

6.1.   We will deliver your Products to the delivery address as shown on your Order Confirmation.

6.2.   Logic3 aim to arrange shipment of all in stock items within 7 working days of receiving your Order. Some items may be unavailable and the current stock status is approximate. Logic3 are not able to supply dates by which an item may return to stock.

6.3.   The period stated within which you will receive delivery of your Order is approximate. Products will be sent to the address given by you in your order and stated in the Order Confirmation. Please note that your Products may be sent to you in instalments.

6.4.   Upon delivery of the Products to our carrier we will send you a confirmation of shipment by e-mail, provided you have indicated an e-mail address on the Order Form.

6.5.   Title to any Product ordered will pass to you once Logic3 has received payment in full for that Product and it has been delivered to our carrier for shipment to you.

6.6.   If your delivery address is outside of the UK you may be subject to import duties and taxes, which are levied once a shipment reaches your country. Any such additional charges for customs clearance and taxes must be borne by you. You should note that customs policies vary widely from country to country; Logic3 advises each customer to contact their local customs office for further information.

6.7.   Please note that when shipping Products outside of the UK, you should be aware that cross-border shipments are subject to opening and inspection by customs authorities.

6.8.   Certain items may ship by post and cannot be tracked once they have entered the postal system. All other shipments use carrier delivery for maximum security and tracking.


7. Your Rights to withdraw from the Contract 


7.1.   You may cancel your order at any time prior to your order being processed/ dispatched by contacting us at orders@ferrari-by-logic3.com or by telephone on +44(0)1923 471 010, and stating your Web Order Number. You may also withdraw from the Contract after the Product has been dispatched and you have received our email confirming your Order, but no later than 14 days from the date you receive the Products.

7.2.   Any notice of cancellation should be sent by email to orders@ferrari-by-logic3.com, ensuring that you quote your name, address and Web Order Number.

7.3.   Where you have already received the Products, you can exercise the right to withdraw from the Contract and return the Products to Logic3 providing:

7.3.1. You inform us of your decision to cancel the Contract within 14 days from the date you have received the Products.

7.3.2. The Products are returned in their original condition and packaging, and the security seals on the Product(s) are intact

7.3.3. The Product(s) are returned with the original Invoice(s)

7.4.   Once Logic3 receive notification from you that you wish to withdraw from the Contract (in accordance with these terms) any sum debited from your debit or credit card in favour of Logic3 in relation to your Order will be re-credited back only to the same debit or credit card account as soon as possible and, in any event, within 30 days of notice to cancel the Contract or the Products you wish to return are received by Logic3 in the condition that they were in when delivered to you, whichever is later.

8.  Intellectual Property Rights 


8.1.   iPod, iPhone, iPad and AirPlay are trademarks of Apple Inc., registered in the U.S. and the other countries.  

8.2.   FERRARI, the PRANCING HORSE device, all associated logos and distinctive designs are trademarks of Ferrari S.p.A. The body designs of the Ferrari cars are protected as Ferrari property under design, trademark and trade dress regulations.

8.3.   Logic3 plc & Logic3 International Ltd., UK, are the owners of the Logic3 registered trademarks.

8.4.   All other trademarks, copyrights and trade names are registered properties of their respective owners.

8.5.   Logic3 own registered and unregistered design rights and copyright subsisting in various products within its range. Logic3 are continually updating their products in the interest of improving the quality and design. As a result, some features and the appearance of the products may vary from those shown in this catalogue.


9. Anti-Counterfeiting Policy 


9.1.   Logic3 is a key participant in the fight against fake or copy products and designs to protect its trademarks, designs and products throughout the world, incorporating the use of specialist AC labels and other technology to help identify and take appropriate measures to cease any abuse or infringement of its own or third party Intellectual Property Rights.


10.  Liability 


10.1. This Liability section applies only to the extent permitted by law. For the avoidance of doubt, Logic3 do not exclude or limit any liability for (a) personal injury (including sickness and death) where such injury results from Logic3’s negligence or wilful default, or that of Logic3 employees, agents or subcontractors or (b) fraudulent misrepresentation.

10.2. Logic3 does not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, specifications, prices and descriptions of listed Products and Services.

10.3. Logic3 will do its best to correct errors and omissions as quickly as practicable after being notified of them.


10.5. In the unlikely event that you receive Products which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, Logic3 shall, at its own option, make good any shortage or non-delivery, replace or repair any damaged or defective Products, or refund to you the amount you paid for the Products in question PROVIDED THAT you notify Logic3 of the problem in writing at the address stated in the confirmation e-mail within 10 working days of delivery of the Products to you. NOTHING IN THIS CLAUSE AFFECTS YOUR STATUTORY RIGHTS.

10.6. Logic3 do not accept liability for any indirect loss, consequential loss, and loss of data, loss of income or profit, loss or damage to property and/or loss from claims of third parties arising out of the use of the Logic3 Web Site or for any Products or Services purchased from Logic3.



11. Miscellaneous 

11.1. It is a crime to use a false name or a known invalid debit or credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. Logic3 tracks the electronic "fingerprints" of every order placed on Ferrari-by-logic3.com to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our Web Site.

11.2. Logic3 may amend these Terms and Conditions from time to time, and place the new version on the Web Site. All purchases from the date that the amended terms onwards are placed on our Web Site will be governed by those new terms.

11.3. These Terms and Conditions shall apply when Logic3 accepts your Order by e-mail by using the Order Confirmation, confirming that it has received payment in full for all the Products or Services you have ordered. They shall supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between Logic3 and you relating to your purchase. Logic3 advises that you print off and keep safe a copy of these Terms and Conditions once Logic3 has accepted your order.

11.4. You are advised to read (and are responsible for reading) fully all information on this Web Site fully.

11.5. If any of these Terms are held to be invalid or unenforceable, those Terms will be struck out and the other Terms remain.

11.6. These Terms and Conditions are subject to the laws and exclusive jurisdiction of the United Kingdom

11.7. Each of the provisions of the Contract shall be treated as separate and distinct and in the event that any provision(s) are held by a court of competent jurisdiction or any future legislative or administrative action to be unenforceable, it shall not affect the validity of the remainder and the other provisions shall remain in full force and effect. No particular provision shall be taken as limiting, void or prejudicing or affecting in any way any other provision or any right, remedy or entitlement of Logic3 under general law.


12. Force Majeure


12.1. Logic3 shall not be liable for any loss or damage which may be suffered by you as a direct or indirect result of the supply of Products by Logic3 being prevented, hindered. delayed or rendered uneconomic by reason of circumstances or events beyond Logic3's reasonable control including, but not limited to act of God, war, riot, strike, lock‑out, trade dispute or labour disturbance, accident, break‑down of plant or machinery, fire, flood, storm, difficulty or increased expense in obtaining workmen, materials or transport or other circumstances affecting the supply of the Products or of raw materials therefor by Logic3's normal source of supply or the manufacture of the Products by Logic3's normal means or the delivery of the Products by Logic3’s normal route or means of delivery.

12.2. If the Logic3 has insufficient Products to meet all its commitments due to such circumstances or events, Logic3 may apportion available Products between all its customers as it considers appropriate, at its sole discretion.


13.Defined Terms

13.1. "Contract" means these Terms and Conditions together with your Order Confirmation; 

13.2. "Invoice" means the invoice issued by us to you for the price of the Products; 

13.3. "Order" means an order placed by you in accordance with these Terms and Conditions; 

13.4. “Pre-Order(s)” is a service that lets you Order a Product before the official launch date.

13.5. "Order Confirmation" means the order confirmation issued by us to you indicating acceptance of your Order; 

13.6. "Web Order Number" means the order number issued by us acknowledging you offer to purchase Products or Services from us; 

13.7. "Product" means any product(s) listed on the Web Site which we agree to supply to you on these Terms and Conditions and may include Services; 

13.8. "Services" means any chargeable or other services listed on the Web Site which we agree to supply to you on these Terms and Conditions;
